  I am here to testify on protecting copyright and innovatin in a hyperlinked world. I am among outraged fans of Chinese rock singer, Mr. He Yong (

  Although the copyright infringement occurred in China, we believe there are good reasons it come to attention of all who are concerned with the online copyright protection: On Oct.11, 2005, a great musician’s right was ignored and mocked by SINA Corporation, the China’s No.1 Internet Portal which was listed on Nasdaq in 2000.

  Given the limited publicity that He Yong V. SINA has received out of Chinese world, a brief and simplified recounting of its facts seems necessary. Defendant SINA (

  In August 2005 Mr. He Yong sued SINA for copyright refringement. During the court trial on Oct.11, 2005, in the People’s Court of Haidian District in Beijing, the Plaintiff claimed SINA encroaching his copyright and asked SINA to make a public apology on sina.com, and for compensation of RMB 500 thousand (about US$ 61,000).

  Not challenging the Plaintiff’s charge of its illegal usage of the performance video, the Defendant responded to question whether the Plaintiff is the copyright owner of the songs, although the Plaintiff cited evidence that the songs are registered with China’s official regulations and were written by him 10 years ago. The fact is, through the songs recently pirated by SINA, Mr. He Yong has achieved national wide acknowlegement and approbation and become the idol of millions of China’ youngsters since the songs were published in 1994.

  As China’s biggest internet portal, SINA sought an initial public offering worth up to 70 million US dollars in 2000. However, its consciousness to copyright protection is at stake as He Yong v. SINA suggests; its integrated citizenship is also challenged by its own behaviour, considering it is running an online content provider business.

  The fact in China is, a potential market of 1.3 billion people, many of them used to playing by Napster rules, and selling bootleg copies to the rest of the world. According to the International Intellectual Property Alliance, 95 percent fo the films discs sold in China were pirated copies, as were 85 percent of music recordings. The situation deserves all of who are concerned, no matter where they are around the globe, to do their part to minimize infringing activity.

  We are delighted to see that current climate in China seems encouraging. Chinese government regulations issued in April, with others planned for late this year, seem to make it easier for copyright owners to sue pirates by spelling out the responsibilities of Internet services. And Baidu.com, China’s biggest internet search engine, lost a lawsuit in September to several music companies including Vivendi Universal SA's Universal Music Group, EMI Group PLC, Warner Music Group and Sony BMG, for offering links to internet websits offering pirated music. As a result, Baidu.com agreed to cut off thousands of links and would pay the compensation for the companies. Baidu.com recently just went public for an initial offering worth US$ 80 million in the US stock market.

  We believe that SINA will lose the lawsuit to Mr. He Yong. However, in order to help raise the public consciousness to copyright protection, a global resonance will be very helpful. And apparently, SINA and Baidu.com are both listed in the US stock market, they must ponder American public concerns and accept the US regulations.

  We support Mr. He Yong to consider further legal action in the US. Even in China, we acknowledge the significance of the US Supreme Court’s recent ruling in Metro-Goldwyn-Mayer Studios v. Grokster. It appears that Grokster ruling has encouraged productive negotiation and agreements within the related players. We hope the US and other countries court decisions will lead to a growing acceptance of online business’ obligation for copyright protectin.

  As we understand, in fact, the Grokster decision should be very helpful to the United States as it continues its discussions with other countries about bringing their copyright laws up to date to meet the challenges of the digital networked environment that connects people around the world. Copyright infringement is not just a problem in the United States; it is a major problem in a market like China as well. In fact, to the extent that the Grokster decision provides new legal tools to stop massive infringement, those tools will be of limited use if unlawful services simply locate to jurisdictions where United States law has no applicability and local laws do not reach such conduct. That’s the reason we appeal to your attention.

  We hope He Yong v. SINA, along with other China’s court decisions, will assist the concerned Americans greatly in bringing copyright protection up to date to meet the gloal challenges in a digital networked world in combatting massive copyright infringement. If one of us failed, it likely would have made others’ task immeasurabley more difficult.

  With the acknowledgement of the efforts made by your prestigious organization to protect copyright, we are asking help for conveying this message to your lawmakers, the related regulators, the concerned activists, the consumers, and related investors communities through all possible channels.

  国际机构金融稳定委员会(FSB)周三(4月15日)发布了一份报告,其中阐述了疫情对金融稳定的影响以及为解决这些问题而采取的政策措施。

  根据国际机构的说法,疫情是自全球金融危机(GFC)以来对金融市场的最大考验。但是,FSB认为,由于20国集团(G20)监管改革,市场现在更具弹性,更能抵御大流行。
